Strengthening Fairness in Kamburi’s Papaya Chain: Sharia-Compliant Financing and Market Governance

Abstrak

This study examines the dominance of a single collector in the marketing of California papaya in Kamburi Hamlet, Kamanre Village, Luwu Regency, and evaluates the practice through Sharia economic law and the spirit of Indonesia’s Law No. 5/1999 on monopoly and unfair competition. The study uses a descriptive qualitative design with a socio-legal approach. Data were collected through observation, interviews, and documentation, then analyzed thematically with source triangulation. The findings indicate that market access is concentrated in one collector who controls price information, grading and sorting, and distribution routes. As a result, prices tend to be set unilaterally and farmers’ bargaining power weakens. From the perspective of Sharia, this condition conflicts with the principles of justice (al-‘adl), balance (al-mizan), and public benefit (maslahah) because it can generate uncertainty in standards (gharar) and unequal distribution of benefits. This article recommends strengthening farmer institutions, improving price transparency, establishing mutually agreed grading standards, recording transactions, and using simple written sales agreements to foster a fairer and more accountable supply chain.
